No participant in the construction process is without potential liability, least of all, the CM. In the court\'s eyes, "With control comes responsibility," whether the CM is an agent or at-risk. This session examines each of the sources that affect the CM\'s rights and responsibilities: the CM agreement, as well as standards of care imposed by law, statute, and regulation. Specifically, this session will review current standard form contract requirements, the current state of the law with respect to jobsite safety, and the obligations imposed by OSHA and others that impact safety and health on the construction site - all of which affect the CM\'s risks and potential liabilities
Learning Objectives
- Examine standard form CM agreements and choose the one that best apportions the CM\'s risk and responsibility for jobsite safety
- Manage and mitigate risk by understanding the current state of the law regarding the CM\'s liability for jobsite safety.
- Train personnel to avoid potential areas of liability when executing safety responsibilities throughout the life of the project.
