Resolving Construction Disputes: Comparing Mediation, Arbitration and Litigation

As a follow-up to the recent Claims Avoidance and Dispute Management webinar, this presentation will take a deeper dive into construction dispute resolution. A construction manager, a claims consultant, and an attorney will discuss the pros and cons of the use of Mediation, Arbitration and Litigation to resolve construction disputes. In addition, some case studies will be discussed to demonstrate the differences.

Patrick A. Costello, Esq. is a construction lawyer with over 16 years of experience in complex litigation, dispute resolution and contracts. He has practiced commercial and construction litigation with the construction law firm Venzie, Phillips and Warshawer for over 11 years. Mr. Costello regularly represents owners, construction managers, general contractors, subcontractors, suppliers and sureties in construction litigation, mediation, arbitration, claim resolution and in the preparation and negotiation of contracts.

Ilana Ritvalsky, EIT is an experienced claims professional with a focus on delay analysis. Ilana specializes in structural engineering, schedule analysis and standard of care evaluations. As a Construction Claims Analyst, Ilana performs analyses to determine the cause, extent and resulting damages of construction delays. She reviews and utilizes project documentation for creation of as-built narratives, generates expert reports, and has assisted with resolution of various construction disputes

Rocco R. Vespe, PE, F.CMAA is a Principal at HKA Global. Mr. Vespe has over 40 years of experience in the construction industry including 20 years as a general contractor followed by more than 20 years as a claims consultant and testifying expert. His construction projects include transportation, municipal, hospital and medical, manufacturing and power plants, chemical, petrochemical, hotel, gaming, educational, roads and bridges, parking structures, shopping centers, casinos, as well as commercial and residential buildings. Mr. Vespe has been qualified as an expert in Federal and State courts. He has testified at litigation, arbitration and mediation for local and national construction law firms and attorneys.
