This panel discusses evolving legal issues that should be of concern to CMs and CMARs. The discussion probes the recent Massachusetts case holding a CMAR liable for a design issue because of the CMAR's preconstruction and design role, and the potential impact of this holding on the "new methodology" of a CMAR. The panel also discusses the deteriorating quality of expert-prepared delay claims exacerbated by the "vanishing trial" in the U.S. and the impact of this trend on CMs and CMARs.
